Projects listed in Schedule 1 of the 2020 EIA Regulations are subject to an EIA process as required by regulation 5 (1). Projects listed in Schedule 2 are subject to a screening process to determine if an EIA is necessary, but the developer may wish to undertake an EIA as set out in regulation 5 (2) (b), if they choose.
If adopted, a proposed amendment to Article 6 of the Directive will require Member States to take necessary measures to provide for early and effective public participation in the EIA process. It is possible that this will require that the public be involved at the scoping stage.
2.4 One of the key requirements of an EIA is that potential impacts, where identified, are avoided or reduced if at all possible. The former DETR published a study (DETR, 1997) on this topic, a useful reference that highlights the following practical hierarchy for mitigation:
